Difinition
"Seller", "We" refer to Globalinfotech
Trading.
"Buyer ", "You" refer to any person who
makes use of Our Services.
"Our Services" refer to the agent service of Yahoo!auction,
the agent service of Auto Auction in Japan, or any other services
which we provide.
"The Website" refer to all web pages in the www.usedcar-jp.com
domain. |

General
Buyer shall agree to be bound by these Terms and Conditions
to use Our Services.
And Buyer is responsible for all import rules, regulations,
procedures, taxes and costs at the destination country to
use Our Services.
Buyer shall be requested to observe that vehicles shall not
be used for the purpose stipulated below and also that vehicles
shall not be sold to any third party who may use it for the
purpose stipulated below: 1) Ordinary weapon, mass destruction
weapon including nuclear weapon, chemical weapon, biological
weapon, and sprayer of these weapons, and missile and remote-controlled
aircraft for delivery of these weapons; sales, development,
manufacturing, use and storage of materials related to the
manufacturing facilities of such weapons 2) Any other purpose
of use that Buyer must apply for prior approval for export
from the Minister of Economy, Trade and Industry according
to the Export Control Related Law. Vehicles shall be used
for civil purpose only. |

Prices
All prices of vehicles represent FOB prices. |

Payment
Acceptable form of payment is T/T remittance in Japanese Yen
only.
But in case You have no means to remit in Japanese Yen, You
may remit in the U.S. Dollars or Euro. In that case, any shortage
of amount due to exchange rate fluctuation is to be borne
by yourself.
Please note that you shall bear the bank charges for sending
your payment to our bank account.
You may remit Our Service fee via PayPal as far as our Yahoo!auction
agent service fee and refundable deposit. |

Our
Service
After your successful bid at Yahoo!auction You may make
a shipping request through order form.
We estimate all costs for exporting your vehicle and send
Proforma Invoice to you. You shall give your sign on it and
send it back to us as soon as possible.
You shall pay the full amount of the price written in the
Profoma Invoice within 5 business days from the Profoma Invoice
date for proceeding of Our Service.
After your full payment is confirmed, We purchase your vehicle
from a owner of it, when the ownership of the vehicle is transferred
to you and We initiate shipping procedure of your vehicle.
In case You don't make payment of full amount of price written
in Proforma Invoice in 14 business days after our sending
it, your order is canceled automatically.
After our shipping procedure of your vehicle We send the following
documents to You via Japan Post EMS within 2 days.
The 1st mail
1.Original Bills of Lading
2.Commercial Invoice
3.Original De-regisration certificate(Japanese and English
translated copy)
4.Marine Insurance Policy (if trade term is CIF)
The 2nd mail
1.Original Bills of Lading(2nd Original B/L)
2.Copy De-regisration certificate(Japanese and English translated)
3.Marine Insurance Policy (if trade term is CIF)
Any documents other than the above and pre-shipment tests(JAAI
inspection etc.) may be provided on request at the Your expense.
You shall be required to notify us of such requirements when
You make a shipping request through order form. |

Our
Service (Yahoo!auction agent service)
You may require us to bid at Yahoo! Auction by using this
Yahoo!auction agent service.
To use this service, You shall remit agent service fee (3,000
Japanese Yen) and a refundable deposit for cancellation of
successful bid (20,000 Japanese Yen).
After your full payment (agent service fee 3,000 Japanese
Yen and refundable deposit 20,000 Japanese yen) is confirmed,
You with deposits may make a bid request through the Inquiry
Form. Until You reach a satisfactory dicision, We provide
the exhibits data of Yahoo!auction in English.
a) If the first bid is successful.
After our successful bid at Yahoo!auction, We estimate all
costs for exporting your vehicle less your deposit 20,000
Japanese Yen and send Proforma Invoice to you.
You shall give your sign on it and send it back to us as soon
as possible.
You shall pay the full amount of the price written in the
Profoma Invoice within 5 business days from the Profoma Invoice
date for proceeding of Our Service.
After your full payment is confirmed, We purchase your vehicle
from a owner of it, when the ownership of the vehicle is transferred
to you and We initiate shipping procedure of your vehicle.
In case You don't make payment of full amount of price written

it, your order is canceled automatically, and we do not return
your deposit for our cancellation fee of Yahoo!auction.
After our shipping procedure of your vehicle We send the following
documents to You via Japan Post EMS within 2 days.

You with deposits may make a bid request through the Inquiry
Form more 4 times.
In case You require us to bid at Yahoo!auction 5 times and
unfortunately all bids end in unsuccessful, You shall pay
additional our Yahoo!auction agent service fee to require
us to bid at Yahoo! Auction.
You shall accept unsuccessful bids because Yahoo!auction has
free opened competitive system.
c) If a bid ends in unsuccessful because of our negligence
or incompetence.
We ruturn agent service fee 3,000 Japanese Yen and deposit
20,000 Japanese yen entirely.
In this case our negligence or incompetence means We don't
make bid or We make wrong bid because of our negligence or
incompetence. |

Cacellation
We may not accept any cancellation after the booking on the
ship is processed. |

Warranty
We offer neither warranty nor guarantee of vehicle.
We assure You that We do our best to prevent dealing with
stolen vehicles, in case a vehicle which We make suncessful
bid is a stolen vehicle, We compensate for your cost.
However in case a vehicle which You make suncessful bid is
a stolen vehicle, We don't compensate for all your costs.
Buyer shall purchase your car at his or her own risk.
To prevent dealing with stolen vehicles, We will check a seller
(in this sentence a seller means a person or company which
sell vehicles at Yahoo!auction) by his or her Driver's License
or Resident Card before our estimate. |

Force
Majeure
We shall not be liable to Buyer for any loss or damage directly
or indirectly arising out of or in connection with any delay
in delivery of the goods, or failure to perform any terms
of these Terms and Conditions where such delay or failure
is caused directly or indirectly by act of God, fire, armed
conflict, labor dispute, civil commotion, intervention of
a government, inability to obtain labor, materials or facilities
and accidents, interruptions of, or delay in transportation
or any other cause beyond the control of us. |

Entire
Agreement
This Terms and Conditions constitute and contain the entire
agreement between Seller and Buyer hereto regarding the subject
matter contained herein and supersede all prior and contemporaneous
agreements, understandings, representations and correspondences
between the parties relating to the subject matters hereto. |

Severability
If any provision of these Terms and Conditions is held by
a court of competent jurisdiction to be invalid or unenforceable.
the remainder of these Terms and Condition shall remain in
full force and shall in no way be impaired. |

10. |
Arbitration
All disputes, controversies, or differences which may arise
between Seller and Buyer, out of or in relation to these Terms
and Conditions or for the breach thereof, shall be submitted
for arbitration to be held in Osaka, Japan. Arbitration shall
be proceeded by one or more arbitrators under the rule of
the Japan Commercial Arbitration Association. The award of
the arbitrators shall be final and binding upon the parties. |

Jurisdiction
In the event that any disputes or controversies arise out
of or in connection these Terms and Conditions or breach thereof,
the Osaka District Court of Japan shall have the jurisdiction
over the disputes or controversies. |

Governing
Law
The existence, validity, construction, operation and effect
of these Terms and Conditions shall be determined in accordance
with and governed by the laws of Japan. |
